Terms of Service

Effective September 23, 2026

These Terms of Service govern purchases and services provided by ÉLEVATE Conversion Studio (“ÉLEVATE,” “we,” “us” or “our”). A proposal, order page, invoice or written scope accepted by both parties may add project-specific terms. If there is a conflict, the project-specific written terms control for that project.

Services and eligibility

Services are intended for businesses and authorized business representatives. We may accept or decline a project based on fit, capacity, legal or platform risk, available materials and scope.

Scope and client responsibilities

The 48-Hour Conversion Creative Sprint includes the deliverables described on the applicable order page. You are responsible for providing complete, accurate and approved materials, instructions, claims, disclosures and feedback. You represent that you have the rights and permissions needed for all materials you provide.

Timing and revisions

Any stated production period begins only after payment is confirmed and ÉLEVATE has approved all required onboarding materials. Delays in materials, access, approvals or feedback extend the schedule. Unless otherwise stated, the sprint includes one consolidated revision round within the agreed scope. New concepts, changed direction, additional formats or later requests may require a separate fee and timeline.

Fees, cancellations and refunds

Fees are stated in Canadian dollars unless indicated otherwise. Because capacity and production time are reserved, fees are generally non-refundable once work begins. Before work begins, any cancellation or refund request will be assessed based on committed time, third-party costs and applicable law. Nothing in these terms limits non-waivable consumer rights.

Intellectual property

You retain ownership of materials you provide. After full payment, you receive the agreed rights to the final approved deliverables for your business marketing. ÉLEVATE retains ownership of working files, unused concepts, methods, templates and pre-existing materials. Unless you object in writing before work begins, ÉLEVATE may display final public-facing work in its portfolio, without disclosing confidential campaign data.

Claims, compliance and platform decisions

You are responsible for the accuracy, substantiation and legality of your offers, testimonials, treatment claims, before-and-after materials and required disclosures. Advertising platforms and regulators make independent decisions; ÉLEVATE does not guarantee approval, distribution, reach or continued availability.

No guarantee of results

Creative performance depends on factors outside our control, including the offer, pricing, audience, media strategy, sales process, market conditions and platform delivery. We do not guarantee conversions, leads, revenue, return on advertising spend or any specific commercial outcome.

Confidentiality

Each party will use reasonable care to protect non-public business information received for the project and will use it only to perform or receive the services, except where disclosure is authorized or legally required.

Limitation of liability

To the maximum extent permitted by applicable law, ÉLEVATE will not be liable for indirect, incidental, special or consequential damages, lost profits, lost data or platform actions. Our aggregate liability arising from a project will not exceed the fees paid for that project. These limitations do not apply where prohibited by law.

Governing law

These terms are governed by the laws of Québec and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The parties will first attempt to resolve disputes in good faith.
